The Platform is software-only and does not hold, custody, or control user funds. All funds remain in the user's own account on third-party cryptocurrency exchanges (e.g. Binance). The Platform does not have withdrawal rights and does not access private keys.

2. User Decision & Control

AI trading activity is user-directed based on Risk Profile Selection in BitAI and Trade Start/Stop Activation. Before any trading can occur, users must: Configure Risk Profile (Low, Medium, High), and manually activate trading by pressing the "Start" button. The Platform cannot initiate trades independently and executes trades strictly in accordance with user-defined instructions. Users may stop trades at any time.

3. No Financial Advice

The Platform does not provide investment, financial, trading, legal, or tax advice. The Platform does not assess a user's financial circumstances or suitability. No content or functionality constitutes a recommendation to buy, sell, or hold any asset. Past performance or simulations do not guarantee future results.

4. No Discretionary Portfolio or Fund Management

BitAI does not provide discretionary portfolio management or fund management services. The Platform does not: Make independent trading decisions; Allocate capital on behalf of users; Modify strategies without user approval. All decisions relating to when, how, and how much to trade are defined and approved by the user.

5. Automated Trading Risks

Users acknowledge that: Automated trading involves significant risk; Losses may occur rapidly, including partial or total loss of capital; Market conditions, volatility, or exchange mechanics may result in unexpected outcomes. Users are solely responsible for monitoring their accounts and managing risk.

6. Third-Party Exchange Risk

The Platform relies on third-party exchanges and APIs. BitAI is not responsible for: Exchange outages or delays; API failures or execution latency; Liquidations, margin calls, or forced closures; Security incidents or changes to exchange rules.

7. No Guarantee of Performance

The Platform is provided on an "as-is" and "as-available" basis. BitAI makes no guarantees regarding: Profitability; Accuracy of execution; System availability or uptime.

8. Limitation of Liability

To the maximum extent permitted by law, BitAI shall not be liable for any losses, damages, or claims arising from: Use of the Platform; Automated trade execution; Market movements or exchange actions.

BitAI is not licensed or regulated by the Monetary Authority of Singapore (MAS) or any other financial authority. The Platform is provided as a technology tool, and users are responsible for ensuring compliance with applicable laws in their jurisdiction.
